⚠️ Maine State Credits Were REPEALED in 2016

Maine used to have excellent child care tax credits, but they were sunsetted effective January 1, 2016.

Former Credit Statute Status
Quality Child Care Investment Credit § 5219-Q REPEALED
Employer-Assisted Day Care Credit § 2524 REPEALED

Note: LD 1555 was proposed in 2025 to create new employer child care credits, but has not been enacted as of January 2026.

The 2026 Maine Reality: Federal Only

Maine employers can still claim the powerful federal Section 45F credit. While there's no state credit to stack, the federal credit alone provides significant savings.

40-50% Federal Section 45F Credit

Claim a tax credit for 40% (Large Business) or 50% (Small Business) of qualified child care expenses, up to $600,000 annually.

+
0% No State Credit Available

Maine's state credits were repealed in 2016. Focus on maximizing the federal 45F credit and community partnerships.

💡 The Maine Strategy: Community Partnerships

Since there's no state tax credit, Maine employers must use other levers: community infrastructure investments and the CEI Child Care Business Lab. The federal 45F credit still covers 40-50% of your costs!

🔬 The "Jackson Laboratory" Model (Bar Harbor)

The Challenge: Maine is rural. Finding a provider is often harder than paying for one.

The Solution: JAX built a $4.5 million, 6,800-square-foot on-site child care center directly on their Bar Harbor campus—the "Island of Imagination Early Learning Center" (opened 2024). They then contracted with the Downeast Family YMCA (out of Ellsworth) to operate it.

The 45F Angle: Building an on-site facility and contracting an outside operator is exactly what the federal 45F credit is designed to subsidize. Under the new OBBBA rules, JAX could claim up to $500,000 annually against this investment.

The Rural Reality: Due to severe local staffing shortages, the Downeast Family YMCA had to pull out of the operating contract in late 2025, forcing JAX to seek a new operator for 2026. This perfectly validates the rural Maine challenge: staffing and finding care is often harder than paying for it.

"Build it, staff it, and use 45F to pay for it."

🏠 The CEI "Child Care Business Lab"

The Resource: Maine has a unique program called the Child Care Business Lab run by Coastal Enterprises, Inc. (CEI).

The Employer Angle: While this program is designed for providers, smart employers are sponsoring employees or spouses to go through this lab to open home-based daycares that serve the company's workforce.

💡 Pro Tip: Can't find care nearby? Sponsor a local entrepreneur to go through the CEI Child Care Business Lab and open a facility near your office.

Maine-Specific Example: The "Rural Employer" Scenario

A manufacturing company in Lewiston with 150 employees uses the federal 45F credit and community partnership strategies.

Strategy Annual Investment Federal 45F Credit (40%) Net Cost
Contracted Slots at Local Center (20 children) $200,000 $80,000 $120,000
CEI Business Lab Sponsorship (2 entrepreneurs) $10,000 $0 (not 45F eligible) $10,000
R&R Agency Contract (referral services) $15,000 $1,500 (10% rate) $13,500
Total $225,000 $81,500 $143,500

🌲 The Maine Reality

Without a state credit, the federal 45F credit still provides $81,500 in savings on a $225,000 investment. The CEI sponsorship ($10,000) doesn't qualify for 45F but creates new child care supply in your community—a long-term workforce investment.

Why Maine Employers Must Think Differently

Maine's rural nature means the challenge isn't just affording child care—it's finding it. The Jackson Lab model shows that sometimes the best investment is creating new supply, not just subsidizing existing spots.

  • Portland – Healthcare, tourism, professional services (highest demand)
  • Lewiston-Auburn – Healthcare, manufacturing
  • Bangor – Healthcare, retail, education
  • Bar Harbor / MDI – Research (Jackson Lab), tourism
  • Augusta – State government, healthcare

Maine Section 45F FAQ

Does Maine have a state employer child care tax credit?
No. Maine's employer child care credits (Quality Child Care Investment Credit § 5219-Q and Employer-Assisted Day Care Credit § 2524) were repealed effective January 1, 2016. Maine is now a "Federal Only" state.
What happened to Maine's child care tax credits?
Maine had excellent child care tax credits, but they were sunsetted in 2016. LD 1555 was proposed in 2025 to create new employer child care credits, but has not been enacted as of January 2026.
Can I still get tax benefits for child care in Maine?
Yes! The federal Section 45F credit is still available and provides 40-50% of qualified expenses (up to $600,000 annually). You just can't stack it with a state credit in Maine.
What is the Jackson Laboratory child care model?
Jackson Laboratory (JAX) in Bar Harbor built a $4.5 million on-site child care center on their campus (the "Island of Imagination Early Learning Center," opened 2024) and contracted the Downeast Family YMCA to operate it. This "build and contract" model is exactly what the federal 45F credit subsidizes. Rural reality check: Due to staffing shortages, the YMCA had to pull out of the operating contract in late 2025—proving that in rural Maine, finding operators is often harder than funding facilities.
What is the CEI Child Care Business Lab?
The Child Care Business Lab is run by Coastal Enterprises, Inc. (CEI). It helps entrepreneurs start child care businesses. Smart employers sponsor employees or spouses to go through this program to open home-based daycares that serve the company's workforce. Can't find care? Create it!
Is there hope for a new Maine state credit?
Maybe. LD 1555 was proposed in 2025 to create new employer child care credits. Contact the Maine Children's Alliance or your state legislators to advocate for its passage. Until then, maximize the federal 45F credit.
