What this guide does—and does not—do
The IRS says employers use Form 8882, Credit for Employer-Provided Child Care Facilities and Services, to claim the credit. This guide organizes the evidence to gather before a filing review; it does not replace current form instructions, a tax return review, or professional advice.
1. Classify each expenditure before calculating
Separate facility-related qualified child care expenditures from resource-and-referral expenditures. Do not blend payments merely because they relate to working parents. For each material amount, document the selected Section 45F path and the legal / operational facts supporting it.
Qualified child care expenditures
Potentially include qualifying facility capital costs, facility operating costs, direct qualified-facility contracts, and certain intermediate-entity contracts.
Referral expenditures
Use a separate category for contracted child care resource-and-referral services. The published rate is 10% and the category shares the annual credit cap.
Review-required amounts
Do not assume that direct employee cash, reimbursements, or loosely documented care support qualify. Obtain a fact-specific analysis before including them.

Calculate the qualified child care component at the applicable 40% or 50% rate and calculate the resource-and-referral component at 10%. Apply the single annual federal cap of $500,000, or $600,000 for an eligible small business. 4. Review general-business-credit and tax-return treatment
Section 45F is part of the general business credit. A qualified advisor should assess tax-liability limits, entity / partner allocation, carryback or carryforward treatment where applicable, other form interactions, state treatment, and the no-double-benefit rules. For qualifying facility acquisition, construction, rehabilitation, or expansion expenditures, the facility basis is reduced by the related credit.
5. File using current IRS materials
Use the current Form 8882 information page and the current form / instructions available from the IRS. The page should be checked at the time of filing rather than relying on a cached document or a website summary.
